THORLOS® - PRIVACY POLICY

THOR·LO, Inc. and its subsidiaries and affiliates (collectively, "THOR·LO," “we,” “our,” “us”) recognizes the importance of protecting your privacy. This Privacy Policy outlines the information THOR·LO may collect and how we may use that information through https://www.thorlo.com/ (the “Site”). By accessing or otherwise using the Site, you acknowledge that you have received and read this Privacy Policy. This Privacy Policy only applies to the Site and does not apply to information collected or received by THOR·LO through other means.

1.  Updates to this Privacy Policy

We reserve the right, at any time, to modify this Privacy Policy. All such modifications will be effective upon posting the revised Privacy Policy on the Site and we will revise the Effective Date at the top of this Privacy Policy. We encourage you to review this Privacy Policy periodically so that you keep up to date on our most current Privacy Policy and practices.

2.  What Information does THOR·LO Collect?

THOR·LO collects information in two ways: (1) directly from you; and (2) automatically as a result of your use of the Site.

Information Collected Directly from You: We may collect and retain any information directly provided by you in connection with your use of the Site. For example, we collect the information you provide us when you:

  • Register for or manage an account with us;
  • Communicate with us, such as to provide feedback, provide a review or testimonial, ask for additional information or make a request;
  • Make a purchase through the Site; or
  • Subscribe to newsletters, email lists or other content that we provide.

We may collect information such as your first and last name, home or other physical address, email address, telephone number, credit card or other payment information and any other information that you provide to us. You may choose not to provide certain information to us, but doing so may restrict your ability to use the Site.

Information Collected Automatically. When you use the Site, we may collect certain information through the use of automated means. We may collect information such as:

  • Your IP address;
  • The type of browser, devices and operating systems you use;
  • Identifiers associated with the device(s) you use to access the Site;
  • The pages you visit and the products you view, including dates and times;
  • If you navigated from or navigate to another website and the address of that website;
  • Information regarding your internet service provider; and
  • Data from third party applications or websites, if you connect to the Site or register for an account through a third party application or website.

In addition, we may collect information about your activities on the Site through the use of cookies, clear GIFs or web beacons, local shared objects or Flash cookies, or through other identifiers or technologies, including similar technologies, as they may evolve over time. We refer to these technologies collectively as “Data Technologies.”

We may allow third parties, including Google, to use Data Technologies on the Site. The information collected by Data Technologies may be shared with and used by us, by others acting on our behalf, or by third parties subject to their own privacy policies. Information collected by Data Technologies may be used on this or on other websites or services, including those that may not be operated by us.

Email. We may collect information regarding the effectiveness of our email and other communications with you. For example, we may know if you open an email we send or follow a link in an email we send to you.

 

3.  How Does THOR·LO Use the Information it Collects?

We use the information we collect to:

  • Deliver the Site to you and others;
  • Provide you with products and services you request or purchase, or that may be of interest to you;
  • Create, administer and maintain your account if you create one;
  • Operate our business, including monitoring, maintaining and improving the functionality of our Site;
  • Understand the needs and preferences of our users;
  • Delivering content (including advertising) that correlates to our users’ interests based on the ways in which our users interact with the Site, third party websites and advertisements;
  • Perform research and data analysis aimed at improving our products, services and technologies, and for marketing, financial, operational or other purposes;
  • Communicate with you about our business or provide you with information that you have requested;
  • Comply with applicable laws and to enforce our policies and Terms and Conditions; and
  • Prevent fraud, theft, or injury to you, us or others.

 

4.  With Whom Do We Share the Information that We Collect?

We may share the information we collect (i) as you expressly authorize us to; (ii) as permitted by law; and (iii) with third parties, including:

 

Service Providers. We may share information with service providers who help us to administer our Site, provide technical support, sending marketing, promotions, and communications related to our business, and process payments. These service providers include analytics companies, advertising networks and others, such as those that provide Data Technologies on the Site.

Business Partners. We may also partner with other entities as part of our business and we may share information with those entities as part of such ventures.

Advertising Networks. We may work with advertising networks that deliver targeted advertisements to consumers and generate statistics and metrics related to the delivery of such advertisements. Advertising networks collect information about the websites that you visit and the advertisements that you interact with and uses it to serve you targeted ads based on your inferred interests and preferences as well as for auditing, research and reporting to us and other advertisers. This data collection takes place both on this Site and on third-party websites that participate in the advertising networks.

Business Transfer. We may share information we have gathered about you in connection with the sale or merger of our business or the transfer of assets.

We may also disclose information in response to subpoenas, warrants, or court orders, or in connection with any legal process, or to comply with relevant laws. We may also share your information in order to establish or exercise our rights, to defend against a legal claim, or to investigate, prevent, or take action regarding possible illegal activities, suspected fraud, safety of person or property, or a violation of our Terms and Conditions.

 

5.  Your Choices

You may limit and control the information provided to us in a number of ways; however, you may not be able to use all features of the Site if you limit the information you share with us.

Account Information. If you have registered for an account through the Site, you may correct, update or delete the information contained in your account by logging in to your account and editing your information. Note that we may keep historical information in our backup files as permitted by law.

Emails. You can stop receiving promotional emails by submitting a request to the address in the “Contact Us” section below or following the unsubscribe instructions in e-mails that you receive. If you decide not to receive promotional emails, we may still send you transactional communications, such as those about your account, orders you have made or other service-related communications.

Connections to Third Party Applications and Services. Connecting your account with us to third-party applications or services is optional. If you have chosen to connect your account to an external third party application, such as Facebook, you can change your settings and disconnect your account from the third-party application.

Cookies. Your browser and your device may provide you the option to limit the use of cookies or other Data Technologies. You should refer to your web browser’s or mobile device’s options or settings menu for more information about adjusting your settings. Disabling or rejecting cookies may disable some of the features and functionality of the Site.

Google Analytics. Google’s ability to use and share information collected by Google Analytics about your visits to the Site is restricted by the Google Analytics Terms of Use, available at http://www.google.com/analytics/terms/gb.html and the Google Privacy Policy available at https://policies.google.com/privacy?hl=en. Targeted Advertising. Many companies that collect information for targeted advertising are members of either the Network Advertising Initiative (“NAI”) or the Digital Advertising Alliance (“DAA”). The NAI and the DAA offer the ability for you to opt-out of the targeted advertising programs of their members. The NAI op-out is available at http://www.networkadvertising.org/managing/opt_out.asp and the DAA opt-out is available at http://www.aboutads.info/choices. Please note that if you use a different computer, change your web browser, or delete your cookies, you will need to renew all of your opt-out choices. Please also note that this does not opt you out of being served advertising but only excludes you from targeted (i.e. interest-based) advertising. If you use the Site, you will continue to receive generic advertisements.

 

6.  Children

The Site is intended for general audiences and is not directed to children under 13 years of age. We do not knowingly collect personal information from children under the age of thirteen (13). No information should be submitted to or posted to the Site by visitors younger than thirteen (13) years old.

 

7.  Information Security

We take reasonable measures designed to secure and protect information transmitted via or stored on the Site. Despite these measures we cannot guarantee the security of networks, servers and databases we operate or that are operated on our behalf, or that information you transmit to us over the Internet will not be intercepted, deleted or altered.

Please assist us in protecting your information. If a password is used to help protect your account and information, it is your responsibility to keep your password confidential. Do not share this information with anyone and please notify us if you believe that your password has been stolen or might have otherwise been misused. If you receive a suspicious email purporting to be from us, please forward it as an attachment to abuse@thorlo.com.

 

8.  Links

The Site may contain links to websites and services not operated by THOR·LO, including various social media websites, surveys or other promotions. We suggest that you review the applicable privacy policy of the third party website or service regarding, among other things, how they will handle any information they collect from or about you. We are not responsible for the content of third party services or websites, your use of those services or websites, or the privacy practices of the third party operating those services or websites.

 

9.  California and Delaware “Do Not Track” Disclosures

California and Delaware law require THOR·LO to indicate whether it honors “Do Not Track” settings in your browser concerning targeted advertising. At this time, there is no worldwide uniform or consistent industry standard or definition for responding to, processing, or communicating Do Not Track signals. Thus, like many other websites and online services, we are currently unable to respond to Do Not Track Signals. 10.  California Privacy Rights

Under California law, California residents have the right to request in writing from businesses with whom they have an established business relationship the following information: (a) a list of the categories of personally identifiable information, such as name, e-mail, and mailing address, and the type of services provided to the customer, that a business has disclosed to third parties (including affiliates that are separate legal entities) during the immediately preceding calendar year for the third parties’ direct marketing purposes, and (b) the name and address of all such third parties. To request the above information, please email us at customercare@thorlo.com with a reference to California Disclosure Information. For all requests, you must put the statement “Your California Privacy Rights” in the body of your request, as well as your name, street address, city, state, and zip code. Please note that we are not responsible for notices that are not labeled or sent properly, or that do not have complete information. Please allow 30 days for a response.

 

11.  Visiting the Site from Outside the United States

This Site is not intended for visitors outside the United States and Canada. If you are visiting the Site, or any part thereof, from outside of the United States, please be aware that your information may be transferred to, stored or processed in the United States, where our servers are located and our central database is operated.

 

12.  Canadian Privacy Rights

The file containing your personal information is maintained on our servers or those of our service providers, and is accessible by authorized employees, representatives and service providers. To request access to or correction of your personal information in our custody or control, or if you have any questions, please contact us in accordance with Section 13 below.
